COLLECTING PERSONAL INFORMATION & YOUR OBLIGATIONS UNDER AUSTRALIAN PRIVACY LAW

Collection:​ You can only collect the personal information necessary to assess your client’s needs and provide services to them.

Use:​ You can only use the personal information you collect to provide the agreed services to your clients and for no other purpose, unless your client actively agrees in writing.

Confidentiality:​ You must keep confidential and not disclose the personal information you collect, unless it is to a medical professional, for a medical emergency or required by law.

Security:​ You must ensure that the personal information is kept secure and is only accessed by your employees or other persons necessary to provide the services to your clients.

Employees:​ You must ensure that your employees or subcontractors understand these privacy obligations and are under the same duty of confidentiality that you are.

Access:​ You must ensure that your clients can ask about and access their personal information at any time, and allow them to unsubscribe easily from any marketing lists.

Up-to-date:​ You must ensure that the personal information you collect is kept up-to-date, particularly any new medical conditions, injuries etc.

Destruction:​ You must destroy a client’s personal information within a ‘reasonable’ length of time if you are no longer working with them. Their information cannot be kept ‘just in case’ and you have to re-collect up-to-date information if they become your client again.

Purging:​ You must have a compliance system in place to ensure personal information you no longer require is regularly purged from your client database and securely destroyed
